The Cost of Getting TDS Wrong
TDS defaults are one of the most common — and most avoidable — tax penalties for businesses. Here's what's at stake:
Late Filing Fee
₹200 per day under Section 234E — from due date until filing
Late Deposit Interest
1.5% per month under Section 201(1A) on unpaid TDS
Penalty for Non-Filing
₹10,000–₹1,00,000 under Section 271H for returns not filed within 1 year
Frequently Asked Questions
Who is required to deduct TDS and file TDS returns?
Any person or entity making specified payments — salary, rent, professional fees, contractor payments, interest, etc. — above the prescribed threshold is required to deduct TDS and file quarterly returns. This includes companies, firms, individuals with audit liability, and HUFs.
What is the penalty for late TDS return filing?
A late filing fee of ₹200 per day under Section 234E applies from the due date until the return is filed. Additionally, a penalty of ₹10,000 to ₹1,00,000 under Section 271H may be levied for returns not filed within one year of the due date.
What happens if TDS is deducted but not deposited on time?
Interest at 1.5% per month (or part thereof) is charged under Section 201(1A) from the date of deduction to the date of deposit. Late deposit also triggers a default notice from the Income Tax Department.
Can TDS returns be revised after filing?
Yes. TDS returns can be corrected by filing a correction statement on the TRACES portal. Common corrections include updating PAN details, challan details, deductee information, and deduction amounts. We handle all types of correction filings.
What is Form 26AS and how does it relate to TDS?
Form 26AS is a consolidated tax credit statement that shows all TDS deducted against your PAN. Errors in TDS returns directly affect the deductee's Form 26AS and their ability to claim credit. Accurate filing is essential to avoid mismatches.
Do I need a TAN to deduct TDS?
Yes. A Tax Deduction Account Number (TAN) is mandatory for all entities required to deduct TDS. It must be quoted in all TDS challans, returns, and certificates. We can assist with TAN application if you don't have one.
